The Criminal Court number 4 of Pamplona has condemned today accordance to four years in prison for four crimes of violation of privacy to the employee of a hamburger restaurant in Pampona, Jonathan Patricio MQ, of Ecuadorian nationality and of 30 years oldby having recorded to many other co-workers while changing clothes in the locker room.
The Public Prosecutor’s Office initially asked the accused for 60 months in prison, although it already warned that he would only have three times the maximum sentence as full compliance. Then he also proposed the expulsion from Spanish territory, which was finally rejected from the agreement.
The defendant, who had a previous criminal record for having been convicted of driving under the influence of alcohol, will not enter prison as the sentence has been suspended on the condition that he does not commit a crime in five years.
To formalize the agreement, the judge listened to the opinion of the victims who expressed their wish that the matter be closed as soon as possible.
He will have to face in four months the civil liability of 3,000 euros to compensate the four affected and must complete 292 days of work for the benefit of the community. In addition, he will have to undergo a sexual training and education program to correct his behavior.

The facts with which the defendant has settled state that “he worked as a manager in a hamburger restaurant in Pamplona, and that with the intention of seeing his co-workers at the time they proceeded to change their clothes, on the 8th and 30th of November 2019, and December 1 and 8, 2019, she placed her mobile phone in recording mode in the locker room where they changed during work shifts.
In this way, he recorded four workers, 23, 24, 27 and 36 years old, who “at the moments in which they took off the clothes they were wearing, they stayed in their underwear and put on their work uniform”, the reverse. In addition to the non-pecuniary damage suffered by all of them due to the invasion of her privacy, one of the victims presented symptoms of anxiety, sadness and sleep disturbance, among other consequences.
